Introduction

Power Biztonságtechnikai Kereskedelmi Kft. (hereinafter: “Power Kft.”, the “Company”, “we”) respects your privacy and is committed to protecting personal data.

This Privacy Policy (hereinafter: the “Policy”) describes the types of personal data we process in connection with your use of the Techson Home mobile application developed for mobile devices and tablets (hereinafter: the “Application”), the purposes and legal bases of such processing, and the measures implemented to ensure the protection of personal data.

This Policy applies to information collected during the use of the Application or in connection with the Application, as well as to electronic communications (including e-mail, SMS, and other electronic messages) sent through or in connection with the Application.

Please note that certain data processing operations relating to the operation of the Application involve technological partners, whose data protection roles are described in detail in the later sections of this Policy.

Data Controller

In connection with the operation of the Techson Home Application, multiple data protection roles may be involved depending on the nature of the specific data processing activity.

Power Kft. acts as Data Controller in particular with respect to:

  • distribution of the Application and the creation of user accounts;
  • communication with Users;
  • data processing related to contractual relationships;
  • primary handling of data subject rights

Certain technical and server-side processing operations necessary for the functioning of the Application are carried out in cooperation with technological partners, whose data protection roles are detailed in subsequent sections of this Policy.

Data Processors

In providing the Service, Power Kft. engages data processors who process personal data solely on the basis of documented instructions from Power Kft.

Primary Data Processor:

Zhejiang Dahua Technology Co., Ltd. (hereinafter: “Dahua”) – cloud infrastructure and technical operation.

The processing activities of data processors comply with Article 28 of the GDPR. Transfers of personal data are subject to the European Commission’s Standard Contractual Clauses (SCCs).

1. How We Process Your Personal Data and the Purpose of Processing

We may process various types of personal data relating to you, including data by which you may be directly identified (for example, name, postal address, e-mail address, telephone number; hereinafter collectively referred to as “Personal Data”).

We may also process data relating to you that does not individually identify you, such as demographic data, information relating to your internet connection, data concerning the devices used to access our Services, and usage data.

You are entitled to decide whether to provide the requested personal data. However, please note that if certain data is not made available to us, we may not be able to provide certain functions or services of the Application.

Depending on the specific processing activity, the role of the data controller may vary, as described in detail in this section.

Certain technical and server-side processing operations are carried out within the cloud infrastructure necessary for the operation of the Application, involving technological partners.

1) Personal Data Processing Activities

A. Use of the Techson Home APP and Cloud

Legal basis for processing, from paragraph 1(a) to paragraph 12:

1. Performance of the contract under the Techson Home Terms of Use and the maintenance of legitimate interests in order to maintain our contractual relationship, to provide services in compliance with the legal requirements of the country/region selected by you, to enable the enjoyment of the services described in the user guide, to keep our products up to date and relevant, to develop our business and ensure the security of our products, and to ensure that the use of our products complies with the Accepted Terms

1.a Activity: When you first register for the Techson Home Application

Data type:
E-mail address; country or region selected; nickname used; password (encrypted); profile photo (if uploaded;

Processing purposes:

  • Creation and activation of the user account,
  • identification of the user and enabling login,
  • ensuring communication related to the user account.

Uploading a profile photo is voluntary, and its absence does not affect the basic functioning of the Techson Home Application.

1b. Activity: When you change the data used for registration

Data type:
If you decide to change any of the above information, the new data will be collected in place of the previous data.

Processing purposes:

  • keeping the user account data up to date,
  • implementing modifications initiated by the user,
  • ensuring the continuous and proper operation of the Service.

2. Activity: When you log in and use our Services

Data type:
In addition to the information mentioned in Section 1, we process data relating to your mobile device and internet connection used for login, such as GPS data, the operating system of your mobile device, its specific model and unique identifier, IP address, MAC address, software version, network access mode and type, latitude and longitude (where necessary), gyroscope (gravity-activated sensor) data, and operational logs, as well as certain details regarding access to and use of the Application, including traffic data, logs and other communication data, and the resources that you access through or within the Application.

Processing purposes:

  • ensuring login and user session management,
  • ensuring the proper and secure operation of the Application,
  • preventing misuse and detecting and remedying errors.

If you do not wish us to collect the information specified in Section 2, you may disable automatic tracking by accessing the “About” menu in the Application and disabling the User Experience Package function, or by not downloading the Application, or by clearing the cache. 

3. Activity: When you add compatible hardware to the Techson Home Application

Data type:
Hardware unique identifier (e.g., serial number / SN) Hardware model
Technical data required for network configuration (e.g., Wi-Fi network identifier)

Authentication data related to the hardware (in encrypted form)
Hardware time zone and daylight saving time (DST) settings

Processing purposes:
Execution of the hardware addition initiated by the user, assignment of the hardware to the user account, and ensuring the basic configuration and operation of the hardware through the Application.
Providing the data required for adding the hardware is a condition for using the Service.

4. Activity: When you use the Live View function, which provides real-time video display

Data type:
Hardware SN; hardware IP; hardware port information; (real-time) video stream

Processing purposes:
Providing real-time video viewing initiated by the user and displaying the operation of the connected hardware through the Application.
During the use of the Live View function, the video is not recorded or permanently stored by the operator of the Application.

5. Activity: When you use the playback and video recording functions

Data type:
Hardware SN, hardware channel identifier, Record Files Path, (real-time) video stream

Processing purposes:
Recording video footage initiated by the user, providing playback of the recorded footage, and applying the retention and deletion settings defined by the user.
The handling of video recordings is carried out solely on the basis of the user’s decisions and settings.

6. Activity: When you activate and configure the settings of the added compatible hardware

Data type:
MAC address; IP address; Hardware SN; Hardware model; Hardware firmware version; country information (via IP address); hardware location (via IP address); date of hardware registration; hardware channel information; hardware offline/online status; hardware configuration information

Processing purposes:
Ensuring the activation of the hardware and its connection to the Application, applying the settings necessary for the proper operation of the hardware, and displaying the hardware status to the user through the Application.
Operational status data are processed solely to the extent necessary for operating the device and informing the user.

7. Activity: When you set the hardware name and cover image

Data type:
Cover image; hardware name; channel information; hardware model; Hardware SN

Processing purposes:
Facilitating the identification and differentiation of the hardware within the user account and displaying information related to the hardware in the Application.
Setting the hardware name and uploading a cover image are optional, and their absence does not affect the basic operation of the Application.

8. Activity: When you enter the hardware password or use the reset function

Data type:
Hardware SN; the original password (encrypted); your e-mail address (if you reset the password via e-mail)

Processing purposes:
Ensuring the secure use of the hardware, preventing unauthorized access to the hardware, and executing password reset initiated by the user.
Authentication data are processed solely for technical verification purposes, and the Application does not store passwords in readable form.

9. Activity: When you use the Hardware Sharing function

Data type:
Hardware SN; the e-mail address of the recipient of the sharing

Processing purposes:
Refusal to provide such information may only result in your inability to use this function, but it does not affect the normal use of other functions of the Techson Home Application.
The scope and duration of the shared access depend on the settings defined by the user within the Application.

10. Activity: When you use the Delete Hardware function

Data type:
Hardware SN; e-mail address and/or telephone number (only for those customers who register for the Techson Home App using their telephone number).

Processing purposes:
Removal of the hardware from the user account initiated by the user, termination of services related to the hardware, and deletion of personal data related to the hardware from systems associated with the operation of the Application, in accordance with applicable laws.
Refusal to provide such information may only result in your inability to use this function, but it does not affect the normal use of other functions of the Techson Home Application.

11. Activity: When you receive a notification

Data type:
Hardware SN; Push notification ID / alarm snapshot

Processing purposes:
Sending alarm and system notifications to the user.

12. Activity: When you use the Techson Home App cloud services to expand storage capacity

Data type:
Hardware SN; messages and recorded video footage; hardware channel information

Processing purposes:
Provision of the cloud-based storage service used by the user, enabling the storage and playback of recorded video footage.
Refusal to provide such information may only result in your inability to use this function, but it does not affect the normal use of other functions of the Techson Home Application.

13. Activity: When you use the User Experience Program function

Data type:
Browsing history and click behavior, e-mail address, MAC address, and your unique identifier.

Processing purposes:
Analysis of the functionality and usability of the Application, and data processing for statistical and analytical purposes in order to improve the Services.
Refusal to provide such information may only result in your inability to use the User Experience Program, but it does not affect the normal use of other functions of the Techson Home Application. Participation in the User Experience Program is entirely optional and is not a condition for using the Application. You may withdraw your consent at any time in the Application settings.

Legal basis for processing:
Consent (GDPR Article 6(1)(a)) Consent may be withdrawn at any time in the Application settings; such withdrawal does not affect the basic operation of the Application.

14. Activity: When you communicate with Us via e-mail or through the feedback function

Data type:
Contact details provided by the user (e.g., e-mail address) Content of the communication (free-text message, attached information)

Processing purposes:
Responding to the user’s inquiry, providing information related to the Application or the Services, and handling complaints and feedback. During the communication, the user provides data based on their own decision.

Legal basis for processing:
Legitimate interest (GDPR Article 6(1)(f)) – communication with users and handling of inquiries Performance of a contract (GDPR Article 6(1)(b)) – where the inquiry relates to the use of the Service

15. Activity: When you log out of the Techson Home App and terminate the use of our Services

Data type:
Your telephone number (only for those customers who register for the Techson Home App using their telephone number), and/or your e-mail address.
E-mail address and/or telephone number (for user identification).
Data related to the user account and the connected hardware.

Processing purposes:
Execution of the termination of the user account, closure of data processing activities related to the Service, and deletion of personal data in accordance with applicable laws.
Termination may result in the permanent loss of certain services and functions.

Legal basis for processing:

16. Activity: When you use hosting services for device asset management purposes

Data type:
Your e-mail address and your precise geographical location.

Processing purposes:
To notify the hosting service administrator of the device and the Techson Home user, and to enable the administrator to confirm the location of the Techson Home device.

Legal basis for processing:
Consent (GDPR Article 6(1)(a))

B. Other uses of your data

We collect and use product reviews and feedback related to the Application, as well as your responses to surveys that we may request you to complete for research purposes. Such information is primarily used for the following purposes:

  • improving the quality of the Application and related Services,
  • identifying and correcting errors,
  • developing new features and services,
  • supporting customer service processes.

For the purpose of improving the Services, we may also analyze product usage data in aggregated statistical form. These analyses are not intended to identify individual users and do not involve automated decision-making or profiling. Participation in questionnaires and surveys is voluntary, and completing them is not a condition for using the Application.

We collect your correspondence data and copies thereof (including e-mail addresses) when you contact us. We use your contact details to communicate with you, to provide the information you request, to respond to your questions, or when handling your complaints. We may use this data to send you important notices, such as changes to the relevant terms, conditions and policies. As this information is very important for our communication with you, we recommend that you receive and read such communications.

The law may require us to collect and share your identification data and other information with public or governmental authorities for the purpose of complying with the law, a court order, or responding to any governmental or regulatory request.

2) Video and Audio Data

The Application enables the User to access and view data recorded by compatible hardware – based on the User’s settings and decisions – in accordance with the Terms of Use.

For the purposes of this Policy, data processed by compatible hardware may in particular include the following:

  • visual data, including in particular video recordings, live video streams, streams and still images;
  • audio data, where the given hardware and function support this and the User expressly enables it;
  • event and sensor data related to the operation of the hardware, including in particular motion sensors, event detectors, temperature sensors, opening sensors, passive infrared sensors, as well as water and environmental sensors.

The Application does not carry out independent monitoring activities and does not determine the purpose of recording video, audio or sensor data. The recording and processing of such data are based solely on the User’s decisions and the operation of the connected hardware.

The primary role of the Application in relation to such data is to provide technical access, display, and – in accordance with the User’s settings – storage of such data.

3) Processing in Compliance with Applicable Laws

In addition to the data processing activities described above, we may process personal data where permitted or required by applicable laws, in particular on the following legal bases:

  • processing is necessary for the performance of a contract or for taking steps at your request prior to entering into a contract;
  • processing is necessary for compliance with a legal obligation;
  • processing is necessary to protect the vital interests of the data subject or of another natural person;
  • processing is necessary for the purposes of the legitimate interests pursued by the Company or by a third party, except where such interests are overridden by the fundamental rights and freedoms of the data subject – in particular where the data subject is a child.

2. How We Share, Transfer and Disclose Your Personal Data

In the following cases, we may share, transfer or disclose your personal data. The User bears full responsibility for any personal data collected or obtained from other sources or from other data subjects.

1) Trusted Third Parties:

We may share your personal data with our subsidiaries, partners, as well as contracted contractors, service providers and data processors where this is necessary for the operation of the Application, the provision of the Services, or the performance of the contract concluded with the Company.

Such third parties undertake contractual obligations to treat your personal data confidentially and to use it exclusively for the purposes specified by us or as permitted by applicable laws.

2) Legal Obligation or Official Request:

We may share, transfer or disclose your personal data where required or permitted by applicable laws, including in particular for the purpose of complying with court orders, legal proceedings, or requests from governmental or regulatory authorities (for example, for the prevention of criminal offences or fraud).

3) Merger, Acquisition or Insolvency:

In the event of a merger, acquisition or insolvency (bankruptcy) proceeding, we may share, transfer or disclose your personal data. In such cases, we require that the successor acquiring the personal data continues to comply with the provisions of this Policy.

3. How We Protect and Retain Your Personal Data

1) Data Protection Measures

We attach particular importance to the security of your personal data. For this purpose, we implement appropriate physical, technical and organizational measures in order to prevent the accidental loss, unauthorized access, use, alteration or disclosure of personal data.

This includes, in particular, the use of encryption technologies, as well as the application of protective mechanisms designed to prevent unauthorized or malicious attacks against personal data.

2) Retention of Personal Data

Personal data are retained only for as long as necessary to achieve the purposes specified in this Policy, unless a longer retention period is required or permitted by law.

When determining the appropriate retention period, we take into account, among other factors, the quantity, nature and sensitivity of the data, the potential risk of unauthorized use or disclosure, the purpose of the processing, and whether the data can be obtained from other sources.

Recordings and alarm snapshots stored in the cloud are retained in accordance with the User’s subscription plan or device settings. The User is entitled to delete cloud-stored recordings at any time within the Application.

In the event of a deletion request, cloud recordings and related metadata are permanently deleted from our servers, unless further retention is required by law or is necessary for the establishment, exercise or defense of legal claims.

4. How We Protect Children’s Personal Data

The Application is not intended for children under the age of 16, nor for persons who have not reached the minimum age required under the applicable jurisdiction.

We do not knowingly collect personal data from children under the age of 16. If we become aware that we have processed personal data of a child under the age of 16, we will delete such data without undue delay, unless the processing is permitted under applicable laws, with the express consent of the child’s legal representative, or is necessary for the protection of children.

5. International Data Transfers

Personal data processed through the Application may be transferred to and stored on servers operated by our OEM cloud service provider – in particular Dahua Europe B.V. and Dahua Technology (HK) Limited.

The OEM cloud service provider acts as a data processor pursuant to Article 28 of the GDPR and processes personal data solely on the basis of the documented instructions of the Company.

6. Your Rights

You are entitled at any time to contact us in relation to your personal data at the e-mail address adatkezeles@powerbizt.hu and to exercise your rights provided under the GDPR.

In particular, you are entitled to the following rights.

  • Right of access: you are entitled to request information as to whether we process your personal data and to request access to the personal data processed by us.
  • Right to rectification: you are entitled to request the correction or completion of inaccurate or incomplete personal data.
  • Right to erasure (“right to be forgotten”): you are entitled to request the deletion of your personal data where there is no further legal basis for the processing or where the processing was unlawful.
  • Right to restriction of processing: you are entitled to request the restriction of processing in the cases specified by law.
  • Right to object: you are entitled to object to the processing of your personal data based on legitimate interests, and you may object at any time to processing for direct marketing purposes.
  • Right to data portability: you are entitled to request that the personal data provided by you be received in a structured, commonly used and machine-readable format, or that such data be transmitted to another controller.
  • Right to withdraw consent: where the processing is based on your consent, you are entitled to withdraw your consent at any time, without affecting the lawfulness of processing carried out prior to such withdrawal..

For the protection of personal data, we are entitled to request verification of your identity prior to fulfilling your request.

7. Amendments to the Privacy Policy

This Policy is reviewed on a regular basis and amended where necessary. In the event of material changes to this Policy, Users will be informed in an appropriate manner, in particular by means of a notification displayed within the Application.
